General terms and conditions of beach me GmbH

1. registration, confirmation
1.1 With your registration, you offer Beach me the binding conclusion of a contract for participation in the event named in the registration form. The contract is concluded when we confirm the booking of the event in writing. Agreements made by telephone or verbally only become binding when confirmed by us in writing.
1.2 The registration is made by the registrant also for all in the registration / lists
for whose contractual obligations the applicant is liable as for his own obligations.
1.3 Participation in Beach me beach volleyball camps is possible for all adults 18 years and older. Younger participants can only take part in Beach me beach volleyball camps advertised as youth camps.
2.1 With the registration the participant fee according to the booked service per person is due. Upon receipt of the invoice by Beach me, a deposit of at least 30 percent of the participation fee shall be paid within 2 weeks. The balance is to be paid at the latest four weeks before the start of the event. Fees in the event of cancellation, processing and rebooking fees are due immediately. The amounts for deposit and balance payment as well as cancellation, if applicable, are shown in the booking confirmation. Payments shall be made in one sum for all registered participants.
2.2 In the case of bookings made at short notice (four weeks or more before the start of the event), the entire participant fee is due immediately.
2.3 In the event that the final payment date is not met, Beach me may withdraw from the existing booking contract after unsuccessfully sending a reminder with a grace period and demand cancellation fees as compensation in accordance with section 3.2. The final information will only be handed out after receipt of the final payment, but no earlier than 14 days before the start of the event.
3. withdrawal by the participant(s), cancellation fees
3.1 It is possible to withdraw from the participation at any time before the start of the event. The date of receipt of the notice of withdrawal by Beach me shall be decisive. The declaration of withdrawal from the event must be made in writing. If a participant/traveller withdraws from the event or does not travel to the event for reasons (with the exception of cases of force majeure as set forth in Section 8) for which Beach me is not responsible, Beach me may demand reasonable compensation for the arrangements made and expenses incurred. When calculating the compensation, any expenses usually saved and any other possible use of the event services shall be taken into account. You are at liberty to prove that no costs or substantially lower costs were incurred in connection with the cancellation or the failure to commence the trip than the costs stated by us in the lump sum (see 3.2).
3.2 The following costs are generally payable in the event of cancellation (including by individual persons) of the Event (Please contact Beach me if you have any questions about cancellation conditions in connection with Covid-19): - up to 30 days before the start of the Event: 40% of the Participant Fee (per person) - from the 29th to the 15th day before the start of the Event: 60% of the Participant Fee (per person) - from the 14th to the 6th day before the start of the Event: 80% of the Participant Fee (per person) - from the 5th day before the start of the Event: 90% of the Participant Fee (per person) - in case of no-show at the start of the Event: 100% of the Participant Fee (per person).
3.3 Beach me recommends that you take out travel cancellation insurance.
4. withdrawal and termination by Beach me
Beach me can cancel the contract without notice, if the participant disturbs the execution of the event despite a warning by Beach me or if he behaves contrary to the contract to such an extent that the immediate cancellation of the contract is justified. If Beach me cancels the contract, Beach me reserves the right to the participation fee minus the value of the saved expenses as well as the saved advantages, which result from a different use of the not taken up achievements.
5. travel duration
The duration of the trip is indicated in whole days. The day of arrival and the day of return are regarded as full days.
6. house rules
In accommodations where there are house rules, such as schools, youth hostels, holiday apartments, holiday homes but also hotels, these must be observed.
7th sports programme
The organizer and Beach me reserve the right to change the program if there are legitimate reasons to do so. Beach me assumes no liability for the non-execution or incomplete execution of the program as a result of circumstances beyond Beach me's control.
8. liability, exclusion of claims and statute of limitations
8.1 The contractual liability for damages that are not bodily injuries is limited to three times the participant fee (per person), insofar as a damage of the participant was caused neither intentionally nor grossly negligently or we are responsible for a damage incurred by the participant solely due to the fault of a service provider. Legal provisions limiting or excluding liability, which are based on international agreements and which may be invoked by a service provider engaged by us, shall also apply in our favour. For all claims for damages in tort against Beach me that are not based on intent or gross negligence, liability for property damage is limited to the amount of three times the participant fee (per person and event).
8.2 In the event of self-touring and travel opportunities organized by Beach me, Beach me shall not be liable for any damages, damages, accidents, losses and other irregularities during the outward and return journey to the holiday destination, as Beach me only acts as an intermediary here, i.e. the transport risk is borne here by each participant.
8.3 Beach me is not liable for service disruptions, personal injury and property damage in connection with external services that are merely arranged or organized by the participants themselves. Beach me is generally not liable in the event of force majeure.
8.4 Participation in sports and other leisure activities is the responsibility of the participants and fellow travellers. Sports facilities, equipment and vehicles should be checked before use. Beach me shall only be liable for accidents occurring during sporting events and other leisure activities if the company is at fault. Beach me recommends that you take out accident insurance.
8.5 In the event of service disruptions, each participant/co-traveller is obligated to cooperate within the framework of the legal provisions to avoid or minimize possible damages. Deficiencies or disruptions must be reported immediately to the Beach me staff on site, Beach me recommends that this be done in writing. If a participant/traveller fails to comply with this obligation through his/her own fault, he/she shall not be entitled to any claims in this respect.
8.6 Beach me employees on site are not entitled to acknowledge any claims.
8.7 Claims for non-contractual performance of the booked event must be made to Beach me within one month after the contractually agreed end of the event. We recommend the written form. After expiry of the deadline, you may only assert claims if you were prevented from complying with the deadline through no fault of your own. Your claims arising from this contract are subject to a limitation period of one year. The statute of limitations begins with the day on which the event should end according to the contract.
9. exclusion from participation
If it turns out that a participant behaves in such a harassing way that the relationship between Beach Me and the service provider (e.g. transport, accommodation, host) is seriously endangered, the participant in question can be excluded from the trip and must immediately leave the accommodation or the venue at his own expense.
10. final clause
The conditions apply to all agreements between Beach me and the contractual partner, regardless of the domiciles of all parties involved and the place where the contract was concluded, as well as the place where the service is to be provided.
